Terms of Service

Welcome to RevenuePost, a social media management and AI content SaaS platform (“RevenuePost”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, applications, and related services (collectively, the “Service”).

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. We may update these Terms from time to time. Material changes will be notified via email or a notice within the application. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Eligibility and User Accounts

• Eligibility: You must be at least 18 years old to use the Service.
• Account Security: You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
• Accuracy: You must provide accurate and complete information when creating an account and keep it updated.

3. Subscriptions and Billing

3.1 Fees and Payment

Certain features require a paid subscription. Fees are billed in U.S. Dollars and are subject to change with at least 30 days’ notice. You authorize us to charge your provided payment method for all recurring fees.

3.2 Auto-Renewal

Subscriptions automatically renew for the same period (monthly or annual) unless canceled before the renewal date. Upgrades take effect immediately, while downgrades or cancellations take effect at the end of the current billing cycle.

3.3 Refunds and Cancellations

• Refund Policy: We offer a 7-day refund window for new subscriptions. We reserve the right to deny refunds if there is significant usage of the service during this period or to limit refunds to one per customer lifetime.
• No Partial Refunds: No refunds are provided for partial months or unused services following the initial 7-day window.

4. Content and Intellectual Property

4.1 User Content (Inputs)

You retain ownership of all content you upload or provide (“User Content”). You grant RevenuePost a worldwide, royalty-free license to host, use, and distribute your User Content solely for the purpose of providing and improving the Service.

4.2 AI-Generated Content (Outputs)

• Ownership: You own the content generated by our AI based on your inputs (“Generated Content”).
• Disclaimer: Generated Content is provided “as is.” We do not guarantee its accuracy, originality, or suitability for any purpose. You are responsible for reviewing and editing AI-generated content before publishing.
• No Infringement: We disclaim liability for any third-party claims resulting from your use of Generated Content.

4.3 Our Intellectual Property

The Service, including its software, code, logos, and trademarks, is the exclusive property of RevenuePost.

5. Acceptable Use Policy (AUP)

5.1 Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or to promote hate speech, obscenity, or harassment.
• Attempt to scrape, reverse engineer, or interfere with the Service’s infrastructure.
• Distribute malware or engage in fraudulent behavior.

5.2 Anti-Spam and Platform Integrity

You must not use the Service to distribute spam, bulk unsolicited messages, or engage in unauthorized automation behavior that violates the terms of connected social media platforms.

6. Social Media Platform Compliance

• API Terms: By connecting social media accounts, you agree to comply with the terms of those platforms, including but not limited to:
  • By using this Client, you agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms).
  • Facebook/Instagram Terms
  • LinkedIn User Agreement
  • TikTok Terms of Service
• Account Stability: We are not responsible for actions taken by third-party platforms, such as account suspensions or shadowbans, resulting from your content or usage patterns.

7. Indemnification and Liability

7.1 Indemnification

You agree to indemnify and hold RevenuePost harmless from any claims, damages, or losses arising from your use of the Service, your User Content, or your violation of these Terms.

7.2 Limitation of Liability

To the maximum extent permitted by law, RevenuePost shall not be liable for any indirect, incidental, or consequential damages. Our total liability for any claim shall not exceed the fees paid by you in the 12 months preceding the claim.

7.3 Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied.

8. Termination

We may suspend or terminate your account at any time for material violations of these Terms. Upon termination, your right to use the Service ceases immediately.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
